Repeat Offenders

At some point, repeat offending code violators become a nuisance to the communities and neighborhoods which code enforcement is intended to serve. Florida State Statutes provide for enhanced penalties in these situations when appropriate. Basically once a violator, a property owner, and/or a tenant is found guilty of violating a specific code at one location, they can be charged as a Repeat Offender if they violate the same code section again even when it occurs at a different location. Penalties may be increased to $500/day, imposed retroactively, and do not require prior written warnings before implementing enforcement. Of course all proper education and legal notice procedures must be followed during the original violation process, as well as any subsequent repeat offenses.
